After setbacks, technical and business related to the Galaxy Note 7, Samsung is going to have to now deal with the dissatisfaction of its customers. And will no doubt have to face, barely a week after suspending production of its smartphone, at least two collective actions initiated by consumer : one has been launched there is little in the United States in the United States and the other was on Wednesday in South Korea.
If last September a user american’s smartphone had filed an individual complaint , now what are three customers in the us the smartphone that have launched a collective action on the 16th of October last. Not so much because the device is proven defective, with a risk of explosions, but because, according to the complaint, filed on October 16 at the district Court of Newark in New Jersey, consumers have had to wait several days or weeks before their phone will not be replaced.
In South Korea, the complainants are considerably more numerous : these are 38 users of a Galaxy Note 7 of which were made public this Wednesday, their project of going to court. According to the law firm of Harvest, the complaint will be officially filed on the 24th of October to the Court for a central district of Seoul.
A compensation of a little more than 243 euros
The plaintiffs are demanding a compensation of 300,000 won (or 243,45 euros), according to the law firm. In their complaint, they note that they have been forced to travel to the shops several times so that the battery in camera is reviewed or that it be exchanged with a new one.
The complaint also points to a prejudice moral, linked to the fact that customers were distressed when they used their Galaxy Note 7 risks related to the safety of the device.
other actions predictable, including in France ?
If these two actions are judged by the courts, they will probably not be the last.
For the time being, in France, no association of consumer appears to be brought to the court. But on the forum of the website of the magazine “60 Million consumers” , more than two hundred owners are manifested in the space of a few days, in a thread calling for a judicial remedy collective against Samsung.
