The object of the claims ? In both cases, it is not the danger or even of errors in industrial Samsung. No, w hat shocked these first complainants, this is the program for recall : it would have frankly been unworthy of a titan of the electronics.
Concretely, in addition to-Atlantic, the justice must determine whether, as the complaint asserts, the exchange program has resulted in “economic damage“, by requiring the buyers of Galaxy Note 7 “to wait for several days, and even weeks in many cases, prior to receiving a new smartphone“. The substantive argument is that those buyers, during this period, “continued to incur expenditure” as part of the monthly payment related to the device and package, “for phones that they could not use“. In other words, Samsung would have wronged by not showing that they were not able to provide a terminal replacement immediately.
similarly, in South Korea, the complainants state the steps simply binding. Forced to come to two times their phones are brand new, and claiming to be the victim of moral harm, they consider that Samsung has not managed its exchange program in a satisfactory manner and therefore demand a compensation in the framework of a complaint, which will be formally filed early next week. The amount of compensation required ? 300 000 won per person, at current prices, approximately 243 euros.
Note that in France, no similar action has yet been initiated, but the UFC-que choisir seems to want to follow the case very closely, while the idea of a class action does not fail to make its way onto the forum of 60 Million Consumers.
