DOCUMENT – The Ministry of Finance had approved the assumption by the party of the former president to fine for exceeding campaign accounts. Lefigaro.fr publishes the full text.

The judicial sky overlooking Nicolas Sarkozy could unravel. Indeed, the payment by the UMP to a penalty of 516,615 euros for exceeding campaign accounts, the case probably more complicated for the former president, is coming off a new turn. This payment gave rise to a preliminary investigation for breach of trust on July 2, 2014. It was conducted by François Molins, the Paris prosecutor, following the designation by the auditors for the UMP, mandated by the new interim leadership of the party, the conditions in which the UMP has set penalties Nicolas Sarkozy.

In its Sunday edition, the JDD revealed that gave Bercy in November 2013 endorsed the payment by the UMP of these penalties. Le Figaro publishes the exchange of letters and notes that attest. Bruno Bezard, Managing Director of Public Finance, one of the highest officials of Bercy, requested by mail to Jean Maia, director of the legal department, a legal opinion on the payment by the UMP, not seeing himself no legal obstacle. On 12 November 2013, a score of 4 pages of Jean Maia states that “no provision seems to oppose what the UMP reimburse the debts of Mr. Nicolas Sarkozy against the Treasury. The electoral law and the law on political parties do not oppose either that the UMP ensure the payment of debts. ” So the department accepts bank transfers of the UMP.

It was only after the arrival of Raffarin-Juppé-Luc Chatel Fillon and the head of the party that the matter will experienced a new twist. At the request of François Fillon, his lawyer, François Sureau, began on JDD legal advice. According to him, the payment would be tainted with illegality and found a “breach of trust”.

After a preliminary investigation began in July after a report of the auditors of the right-wing party the Paris prosecutor had given October 6 judges to financial investigation for “breach of trust”, “complicity” and “concealment”.

On Sunday, the Paris prosecutor’s office said in a statement that launched its investigation “given the only information brought to its attention by the auditors for the UMP.” According to the prosecution “there was never a direct quote in this case, the facts are not undisputed or indisputable. (…) It was decided to open a criminal investigation because it appeared the most suitable for the treatment of this case solution. “
